1. About the service

HMS Klar (hmslederkurs.no) provides online HSE courses for managers covering the Norwegian Working Environment Act §3-5, and is a trading name used by HEM. The service is provided by HEM, a sole proprietorship registered in Norway with organisation number 924 807 342 and business address Folke Bernadottes vei 6, 0862 Oslo.

2. Free access, payment and conclusion of contract

The whole course is free to take. You can start, read every module and sit the final exam without paying, without creating an account, and without entering card details. This free use is an offer without consideration and carries no payment obligation.

What you pay for is access to the guided HSE course under the Working Environment Act §3-5, with the certificate included. Payment happens at the end, after you have passed the exam, when you choose to unlock and receive your certificate. A binding contract for consideration is concluded only at this payment point. The price shown on the payment screen is binding. All card payments are handled by Stripe Payments Europe Ltd. The certificate is the delivery confirmation of an educational service we have already delivered, not a separate product.

The course meets the training requirement in the Working Environment Act §3-5 for employers. We do not certify on behalf of the Labour Inspection Authority (Arbeidstilsynet), and §3-5 has no such certification scheme. What is documented is that the course has been completed and that its content covers the §3-5 requirements.

3. Price and volume tiers

The standard price is NOK 1 290 per seat. Published volume discounts: from 5 seats NOK 990, from 20 seats NOK 790, from 100 seats by agreement. Prices are quoted without VAT because the service is VAT-exempt (see §6 below).

4. Right of withdrawal

Consumer purchases: The Norwegian Withdrawal Rights Act applies only once the paid contract is concluded, that is, at the payment step at the end. By then you have already completed the entire course and passed the exam. On the payment screen you explicitly consent, via a dedicated and separate checkbox, to the certificate being issued and delivered immediately, and you acknowledge that the right of withdrawal thereby lapses (Withdrawal Rights Act §22(n)). The consent is repeated verbatim on a durable medium in the receipt email you receive.

Business purchases: The Withdrawal Rights Act does not apply to purchases made as part of business activity (purchases against an organisation number). Any refunds are governed by these terms.

5. Refunds

The course itself is free to take, so you never pay before you have passed and chosen to unlock the certificate. You can retake the exam at no extra cost if you fail. You therefore pay only for a result you have already achieved.

As a consumer you have, at the payment step, consented to immediate delivery of the certificate and acknowledged that the right of withdrawal has thereby lapsed under §4. Refunds beyond statutory remedies for defects are granted by agreement with us. In the case of technical errors or double charges we of course refund without questions. 6. VAT and human-in-the-loop

Educational services are exempt from VAT under the Norwegian VAT Act (merverdiavgiftsloven) §3-5. The exemption requires us as a provider to actually assist the participant in acquiring the knowledge, not just deliver video and automated tests. We therefore operate a staffed support and Q&A channel with a published response time of 1 business day, available throughout the free course phase. The certificate is a natural part of the educational service (VAT Act §3-5 second paragraph) and is covered by the same exemption, not a separately taxable product.

The price shown is final. No VAT is added on the sales document. The sales document (receipt or invoice) states the VAT treatment explicitly as "VAT-exempt (VAT Act §3-5)" and contains the seller, the buyer for business purchases, date, service and amount as required by the bookkeeping rules.

7. Defects and the Digital Services Act

For consumer purchases, the Norwegian Digital Services Act (digitalytelsesloven, LOV-2022-06-17-56) applies in parallel with the Withdrawal Rights Act. If the course doesn't function as agreed, the consumer has rights to remediation or cancellation under §§25–28, regardless of whether the right of withdrawal has been waived.

8. Certificate of completion

On passing the final knowledge test, a personal certificate is issued with a sequential number in the HMS-{year}-{nnnnnn} series. The certificate is your written documentation under the Working Environment Act §3-5 second paragraph. It is retained for as long as your user account is active and can be downloaded again from your account page or verified publicly via the link on the certificate.

We do not store date of birth or national identification number on the certificate. The identifier is name plus email.

9. Privacy

Personal data processing is described in the privacy policy.

10. Changes to these terms

We may update these terms from time to time. The current version is published on this page, and continued use of the service after an update is considered acceptance of the new terms. Changes do not apply to purchases that have already been completed.

11. Disputes and venue

If something goes wrong, we want to resolve it directly. Please reach out at [email protected] and we will look into it.

If we cannot reach an agreement, consumers may bring the matter before Forbrukertilsynet or Forbrukerklageutvalget. Norwegian law applies, with Oslo District Court as the legal venue. Consumers nevertheless retain the right to bring proceedings in their own home court pursuant to the Norwegian Disputes Act (tvisteloven).
