1. About the service

HMS Lederkurs (hmslederkurs.no) provides online HSE courses and is a trade name of HEM. The service is provided by HEM, a sole proprietorship registered in Norway with organisation number 924 807 342 and business address Folke Bernadottes vei 6, 0862 Oslo.

You can reach us through the contact form at hmslederkurs.no/en/support. We do not receive e-mail; all dialogue goes through the form and replies go to the address you provide.

2. Free access, payment and conclusion of contract

The courses are free to start. For most courses you can read every module and sit the final exam without paying, without an account and without entering card details. In the 40-hour safety representative course, the cases, the industry module and the workplace tasks require signing in with an e-mail code, and the assessment of the tasks is a paid service, see section 12. This free use is an offer without consideration and carries no payment obligation.

For most courses you pay for access to the guided course, certificate included. Payment happens at the end, after you pass the exam, when you choose to unlock and receive the certificate. For the 40-hour safety representative course payment happens when you submit the workplace tasks for assessment, see section 12. There you pay for a guided assessment, which is teaching given by a person: the course lead assesses the workplace tasks, gives written feedback and can return tasks for correction. The certificate is included. The paid service is fully delivered once the folder has been assessed and the certificate issued. The course content and downloading the report are free, also after the assessment, and are not part of the paid service. You can ask the course lead questions throughout the course. A binding agreement for consideration is entered into only at the time of payment. The price shown on the payment screen is binding. All card payments are handled by Stripe Payments Europe Ltd. The certificate is part of the educational service, not a separate product.

There is no public approval scheme for these courses, neither for us nor for any other provider. The courses are built on the content requirements of the rules they cover, and the certificate documents that the course was completed, what it contained and its legal basis. The Labour Inspection Authority assesses at an inspection whether the training has been given and is sound.

3. Price and volume tiers

The price per seat and the published volume discounts are on each course page and the pricing page, and are listed below. From 100 seats, prices are by agreement. Prices are quoted without VAT because the service is VAT-exempt (see section 6).

• HSE course for managers: NOK 1 290 per seat, NOK 990 from 5 seats, NOK 790 from 20 seats.
• Safety representative course, 40 hours: NOK 3 990 per seat, NOK 2 990 from 5 seats, NOK 2 390 from 20 seats.
• Shortened safety rep course: NOK 1 690 per seat, NOK 1 290 from 5 seats, NOK 990 from 20 seats.
• Workplace first aid: NOK 790 per seat, NOK 590 from 5 seats, NOK 490 from 20 seats.
• Working at height & fall protection: NOK 990 per seat, NOK 790 from 5 seats, NOK 590 from 20 seats.
• Psychosocial work environment: NOK 990 per seat, NOK 790 from 5 seats, NOK 590 from 20 seats.
• Fire safety & evacuation: NOK 990 per seat, NOK 790 from 5 seats, NOK 590 from 20 seats.
• Data protection (GDPR): NOK 990 per seat, NOK 790 from 5 seats, NOK 590 from 20 seats.
• Chemicals & safety data sheets: NOK 990 per seat, NOK 790 from 5 seats, NOK 590 from 20 seats.
• Sick-leave follow-up for managers: NOK 790 per seat, NOK 590 from 5 seats, NOK 490 from 20 seats.

4. Right of withdrawal

Consumer purchases of courses paid after passing the exam: The Norwegian Withdrawal Rights Act applies only once the paid contract is concluded, that is, at the payment step at the end. By then you have already completed the entire course and passed the exam. On the payment screen you explicitly consent, via a dedicated and separate checkbox, to access to the guided course, with the certificate, being delivered immediately, and you acknowledge that the right of withdrawal is thereby lost (Withdrawal Rights Act §22(c) and (n)). The consent is repeated verbatim on a durable medium in the receipt email you receive.

Consumer purchases of the 40-hour safety representative course: Here you buy a service: the guided assessment of the workplace tasks, certificate included. On the payment screen you ask for the assessment to start straight away and acknowledge that the right of withdrawal is lost once the folder has been assessed and the certificate issued (Angrerettloven §22 letter c). If you withdraw within the 14-day period and before the assessment is complete, we refund the full amount. The checkbox reads, word for word: "I ask for the review of my folder to start straight away. I understand that my right of withdrawal is lost once the folder has been reviewed and the certificate issued (Norwegian Withdrawal Rights Act § 22 (c))." It is repeated word for word on a durable medium in the receipt e-mail.

Business purchases: The Withdrawal Rights Act does not apply to purchases made as part of business activity (purchases against an organisation number). Any refunds are governed by these terms.

Right of withdrawal: the 40-hour safety representative course (consumers)

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day the contract was concluded, which is the day you pay.

To exercise the right of withdrawal, you must inform us of your decision by an unequivocal statement: through the contact form at hmslederkurs.no/en/support (choose "Withdrawal"), or by letter to HEM (HMS Lederkurs), org. no. 924 807 342, Folke Bernadottes vei 6, 0862 Oslo, Norway. You may use the model withdrawal form, but it is not obligatory. It is enough to send your notice before the withdrawal period has expired.

If you withdraw before the folder has been reviewed and the certificate issued, we refund the full amount without undue delay and at the latest 14 days after we received your notice, using the same means of payment you used. You pay nothing for review work already started.

Once the folder has been reviewed and the certificate issued, the service has been fully performed and the right of withdrawal is lost (Norwegian Withdrawal Rights Act § 22 (c)).

5. Refunds

For the courses you pay for after passing the exam, the course itself is free to take. You never pay before you have passed and chosen to buy access to the guided course with the certificate included. You can retake the exam at no extra cost if you fail. You therefore pay only once you know you have what you need.

If you paid for one of these courses as a consumer, you consented at the payment step to access to the guided course, with the certificate, being delivered immediately and acknowledged that the right of withdrawal has thereby lapsed under section 4. Refunds beyond statutory remedies for defects are granted by agreement with us.

For the 40-hour safety representative course you pay when you submit the folder, before it has been assessed. If you withdraw as a consumer within the 14-day period and before the assessment is complete, we refund the full amount (Withdrawal Rights Act §22 letter c, see section 4). Once the folder has been assessed and the certificate issued, the right of withdrawal is lost. Seats bought by a company are business purchases and follow the rules for business purchases.

6. VAT and human-in-the-loop

Educational services are exempt from VAT under the Norwegian VAT Act (merverdiavgiftsloven) §3-5. The exemption requires us as a provider to actually assist the participant in acquiring the knowledge, not just deliver video and automated tests. For the courses you pay for after passing the exam, we therefore operate a staffed support and Q&A channel where a real person answers subject questions, available throughout the free course phase. For the 40-hour safety representative course the paid service is the guided assessment: the course lead assesses the workplace tasks, gives written feedback and lets you correct and resubmit them. That is teaching given by a person. The certificate is a natural part of the educational service (VAT Act §3-5 second paragraph) and is covered by the same exemption, not a separately taxable product.

The price shown is final. No VAT is added on the sales document. The sales document (receipt or invoice) states the VAT treatment explicitly as "VAT-exempt (VAT Act §3-5)" and contains the seller, the buyer for business purchases, date, service and amount as required by the bookkeeping rules.

7. Defects and the Digital Services Act

For consumer purchases, the Norwegian Digital Services Act (digitalytelsesloven, LOV-2022-06-17-56) applies in parallel with the Withdrawal Rights Act. If the course doesn't function as agreed, the consumer has rights to remediation or cancellation under §§25–28, regardless of whether the right of withdrawal has been waived.

8. Certificate of completion

When you pass the final knowledge test, a personal certificate is issued with a serial number in the series HMS-YYYY-NNNNNN. For the 40-hour safety representative course the certificate is issued once the workplace tasks have been assessed. The certificate documents the completed training, its content and its legal basis. It is stored for as long as the user account is active and can be downloaded again from "my page" or verified publicly through the link on the certificate.

We do not store date of birth or national identification number on the certificate. The identifier is name plus email.

9. Privacy

Personal data processing is described in the privacy policy.

10. Changes to these terms

We may update these terms from time to time. The current version is published on this page, and continued use of the service after an update is considered acceptance of the new terms. Changes do not apply to purchases that have already been completed.

11. Disputes and venue

If something goes wrong, we want to resolve it directly. Send us a message through the contact form at hmslederkurs.no/en/support and we will look into it.

If we cannot reach an agreement, consumers may bring the matter before Forbrukertilsynet or Forbrukerklageutvalget. Norwegian law applies, with Oslo District Court as the legal venue. Consumers nevertheless retain the right to bring proceedings in their own home court pursuant to the Norwegian Disputes Act (tvisteloven).

12. The safety representative courses

The 40-hour safety representative course consists of 18 hours online (nine theory modules, eight cases, an industry module and a final test) and 22 hours of practical tasks at your own workplace (five tasks and a plan for your first six months). You report the time you spent on the tasks. The platform records active time as documentation, but the time never blocks you.

Once the test is passed and the tasks are ready, you submit the folder and pay. The assessment is a service: the course lead assesses the tasks and may send individual tasks back with a note, which you can fix and resubmit. We promise no fixed response time, but assess as soon as we can. The certificate is issued once all tasks have been assessed. Seats bought by a company are prepaid and go straight to assessment. If a company bought your seat, the person who ordered the seats can download the report with task answers, photos, reported time, total recorded time and the manager confirmation once the folder has been assessed and is complete. While the course is running, the person who ordered the seats can see how far each participant has come and the status of the folder (not submitted, in review, sent back, assessed), but not the answers or the comments until the report is ready.

The shortened safety representative course is shorter training under the regulation on organisation, management and participation §3-19. It only fits where the parties in the business have jointly concluded that shorter training is sound. That assessment is the business's, not ours.

For both courses: there is no public approval scheme for safety representative and committee courses. The employer must also provide training in matters of particular importance in the business (§3-18 third paragraph) and clarify practical questions about the training with the union representatives (§3-20).

13. AI tips in the safety representative course

In the 40-hour safety representative course you can, when the feature is switched on, ask for AI tips on your answers. The tips are generated by a language model from Anthropic. The feature is optional and requires your consent.

The tips are guidance for you only. They do not affect the assessment, and the course lead never sees them. The tips may be wrong or incomplete, and you are responsible for the answers you submit.
